The transcranial magnetic stimulation therapy that Dr. Gustavo Kinrys specialized in was so noninvasive that his clients didn’t even know they had sessions. But Kinrys was all invasive when it came to billing Medicare for the supposed services that treat patients with depression. To the tune of $19 million in fraudulent invoices.
Dr. Gustavo Kinrys was a licensed psychiatrist who owned and operated Advanced TMS Associates. Sloopy record keeping may have been the demise of his practice and his scheme. Between January 2015 and December 2018, Kinrys billed Medicare and private insurers for thousands of TMS sessions he never provided. Over 8,000 sessions he supposedly provided to patients, had never received a single session of the therapy.
Kinrys also billed Medicare and private insurers for hundreds of thousands of dollars’ worth of psychotherapy sessions he never provided. For nine hundred of the face-to-face sessions he claimed he provided, he was on vacation in locations like the Bahamas, Punta Cana, Dominican Republic, and the Czech Republic. On three hundred and eighty-two occasions, Kinrys billed Medicare and private insurers for having provided more than 24 hours’ worth of psychotherapy services in a single day. One such day in July of 2017, Kinrys claimed he had provided hour-long psychotherapy sessions to 70 different patients. He was also out of the United States on vacation when this impossible feat occurred.
Seemed suspicious enough for Medicare and the Department of Health and Human Services (HHS) to ask this fraudster for records pertaining to his claims. Which were found to be all fabricated.
On June 8, 2024, Kinrys was sentenced to eight years in prison which will be anything but noninvasive.

A former Wellesley psychiatrist, Dr. Gustavo Kinrys, has been sentenced to nearly 100 months for a multimillion-dollar insurance fraud operation. Dr. Gustavo Kinrys, a psychiatrist who once practiced at Advanced TMS Associates in Natick, Massachusetts, billed for non-existent mental health treatments to the tune of over $19 million, diverting critical care funds. His extravagant purchases, financed through this scheme, included luxury homes and over $600,000 in fine jewelry, according to the U.S. Attorney’s Office.
Yesterday, U.S. District Court Judge Denise J. Casper sentenced Kinrys following his October 2023 conviction on multiple fraud and false statement charges. During the trial, evidence revealed that Kinrys billed for more than 8,000 treatments never provided, although Kinrys claimed they were, as reported by the U.S. Attorney’s Office.
